The Open Door

Officers responded to a domestic disturbance call. The Defendant's wife, a co-occupant of the marital home, consented to officers' entry and led them to an upstairs bedroom where an officer observed a straw with cocaine residue. She reported that her husband Scott used cocaine and that the dispute was caused by his cocaine use. Officers used the observed straw as the basis for a search warrant they subsequently obtained. The Defendant was present and expressly refused to consent to the search.
