The Two-Hour Wait

While the Defendant's wife retrieved her belongings from the home she shared with him, she told officers that Charles had marijuana under the couch. Officers knocked and asked permission to search. Charles refused. Officers prevented him from re-entering the home alone while another officer obtained a warrant — a wait of about two hours. Officers then executed the warrant. They found two small marijuana pipes and a small amount of marijuana under the couch — exactly where his wife had reported they would be.
