The facts
Illinois State Police set up a highway checkpoint to ask motorists about a fatal hit-and-run accident that had occurred at the same location a week earlier. Officers stopped all vehicles briefly to hand out flyers and ask if drivers had seen anything. When the Defendant's minivan pulled up to the checkpoint, an officer noticed he was swerving. The Defendant failed field sobriety tests and was arrested for DUI.
