The facts
On the evening of August 6, 1981, the Defendant and her husband attended a gun club party in Washburn, North Dakota, where both consumed large amounts of alcohol. Their marriage had been troubled for years, deteriorating into alcohol abuse and mutual violence. On the return trip to their farm, an argument broke out. According to witnesses and later testimony, her husband was abusive toward the Defendant throughout the evening. Both parties had engaged in physical altercations that night. After returning home and going to bed, her husband fell asleep. The Defendant got out of bed, went to the kitchen, and retrieved a butcher knife. She returned to the bedroom and stabbed her husband to death. He died within minutes from shock and blood loss. At trial, an expert witness testified that the Defendant exhibited the hallmarks of battered wife syndrome — a psychological condition marked by low self-esteem, learned helplessness, and a genuine belief that she could not escape the abusive relationship and that her husband was invulnerable to outside intervention. The Defendant testified she believed her husband would kill her when he woke up.
