The facts
The FBI identified three public telephone booths on Sunset Boulevard in Los Angeles that the Defendant used on a regular basis to conduct interstate gambling operations. Agents worked with the telephone company to take one booth out of service and bugged the others. FBI agents attached an electronic listening and recording device to the outside of the glass-enclosed public telephone booth that the Defendant used. The device recorded the Defendant's end of telephone conversations. Evidence of the Defendant's end of the recorded telephone conversations was introduced at trial and used to convict him of transmitting wagering information by telephone across state lines.
