The Casino Tape
The facts
Casino surveillance video showed the Accused holding an object that resembled a handgun, following a couple, pointing the object at them, and then appearing to manipulate it near a garbage can. A bullet was later recovered at that spot. A handgun loaded with matching ammunition was found along the route by which he left. The object seen in the video was never recovered, no forensic evidence tied him to the handgun that was found, and he had no firearm on him when he was arrested. The Crown's position was that the video, the bullet at the garbage can, the matching ammunition and the recovered gun on the escape route all pointed one way and had to be weighed as a whole rather than picked apart piece by piece. The Defence position was that the Crown had two separate things to prove - that the object in the video was a firearm at all, and that the gun found on the route was his - and had proved neither.
