Awaiting decisionState v. Powell (Ohio Supreme Court)
Will the Ohio Supreme Court reinstate Sydney Powell's murder conviction?
Where the case stands
The Ninth District Court of Appeals ordered a new trial, holding the trial judge erred by denying the defense sur-rebuttal (recalling its expert) at the close of trial. The State appealed, and the Ohio Supreme Court heard oral argument on Jan. 7, 2026, taking the case under advisement with no ruling timeline.
Background
Akron college student who killed her mother, Brenda Powell, in 2020 after concealing her university suspension. At her 2023 trial she did not deny the attack and pleaded not guilty by reason of insanity; the jury convicted. The case became a national true-crime fixture through gavel-to-gavel trial streams.
Charges
- Convicted 2023: murder, felonious assault, and tampering with evidence; sentenced to 15 years to life
The arguments
Prosecution/State: Prosecutors argue the Ninth District's decision creates a de facto right to sur-rebuttal that could 'serve as a vehicle to entirely rewrite the order of trials throughout the State of Ohio,' and that any error was harmless.
Defense: The defense says the case involves a singular abuse of discretion — the trial court cut off a fair response on the decisive insanity question — not a blanket sur-rebuttal right, so the new-trial order should stand.
The record
- Oral-argument video. The full Jan. 7, 2026 Supreme Court argument is publicly archived on The Ohio Channel.
- Trial video archive. The 2023 trial, including the expert-testimony fight at the heart of the appeal, was streamed and remains archived by Court TV and Law&Crime.
- Crime-scene and interview footage. Body-camera and hospital footage of the 911 response and of Powell's demeanor was played at trial and is available in archived coverage.
The line-setting read at the time this market opened
The court chose to take the State's discretionary appeal, and at argument the justices pressed both the claimed sur-rebuttal right and harmless error — a docket-selection pattern that often, but not always, favors the appellant State. A remand that leaves the new-trial question unresolved would not fit either label and would void the market.
Awaiting decision — The Ohio Supreme Court's opinion — reverse the Ninth District and reinstate the conviction, or affirm the new-trial order. The ruling is posted here, and on the board, the moment it's confirmed by two or more independent news organizations.
