The Colorado Court of Appeals reversed the conviction on April 2, 2026, holding the trial court committed structural error by failing to remove a juror whose son-in-law was a deputy district attorney in the prosecuting office; Judge Neeti Pawar wrote dismissal was needed to preserve 'the appearance if not the reality of fairness in a criminal prosecution.' The Attorney General petitioned the Colorado Supreme Court for review on June 29, 2026.
Background
Stepmother convicted in 2023 of the first-degree murder of her 11-year-old stepson Gannon Stauch, killed in January 2020; she was sentenced to life without parole after a televised trial in which she pleaded not guilty by reason of insanity.

The arguments

Defense: The seated juror's household tie to the prosecuting DA's office violated Colorado's juror-impartiality rules and was structural error, so the reversal should stand and the case return to El Paso County for retrial.
