Background

Jeffrey Epstein's longtime associate, convicted in December 2021 of sex trafficking a minor and related counts and sentenced in 2022 to 20 years. With direct appeals exhausted after the Supreme Court declined her non-prosecution-agreement appeal, she now seeks to void the conviction, arguing the newly released Epstein files expose violations that make it, in her words, invalid, unsafe and infirm.

The arguments

Prosecution/State: Prosecutors call the claims speculative, factually erroneous and procedurally barred, and urge swift rejection; the trial record independently supports every count.

Defense: Newly released Epstein files show constitutional and legal violations — including material the jury never saw — such that no reasonable juror would have convicted her; the 2007 non-prosecution agreement should have barred the prosecution.
